Andrew McCarthy: Closing Gitmo Will Come Back to Haunt US.


A former federal prosecutor says the U.S. media have largely ignored one of the biggest stories of the year: the gradual shutting of the prison camp at Guantanamo Bay, where the United States has held terrorists since the 9/11 attacks.

“They’re gradually shutting [it] down . . . by sending these guys back to their countries, including two who were sent back last week to Sudan,” Andrew C. McCarthy, a columnist for National Review, told “The Steve Malzberg Show” on Newsmax TV.

“So, we’re now taking trained terrorists and sending them back to governments that practice terrorism and that are rabidly anti-American. Go figure.”

“So, it’s not just that we’re reining in the [National Security Agency] program,” McCarthy said. “The administration is really starting to cut off Bush counter-terrorism, which, as long as the president needed to be re-elected, he was all for Bush counter-terrorism.”

McCarthy fears the NSA stands to be weakened, “largely because the intelligence community has really done a terrible job trying to defend it.”

McCarthy, author of “Spring Fever: The Illusion of Islamic Democracy,” is a former assistant U.S. attorney for the Southern District of New York who prosecuted the terrorists who bombed the World Trade Center in 1993.

Saudi Arabia Must Face 9/11 Victims in Revived US Lawsuits.


NEW YORK — Lawsuits claiming Saudi Arabia aided al-Qaida and should be held liable for the Sept. 11, 2001, terrorist attack were revived by a U.S. appeals court in a decision that allows victims and their families another chance to seek compensation from the kingdom.

The U.S. Court of Appeals in New York Thursday said a lower-court judge “rested on an error of law” in rejecting a request to reopen the cases against the country’s government and an affiliated charity.

The Kingdom of Saudi Arabia and the Saudi High Commission for Relief of Bosnia and Herzegovina won a ruling dismissing them from the lawsuits on the grounds that a foreign government is immune from suit.

Subsequently, the appeals court made inconsistent rulings on whether the terrorism claims made in the case fall under sovereign-immunity rule, according to yesterday’s opinion.

The lower-court judge should have granted a request to re- open the cases to allow the inconsistency to be addressed, the appeals court said.

The inconsistent rulings caused “a disparity” between two cases “where none should ever have existed,” the appeals court said.

“We conclude that the circumstances of this case are extraordinary,” warranting its re-opening the three-judge panel said in the ruling. The case will be returned to the lower-court judge for consideration as to whether it should move forward.

Michael Kellogg, a lawyer for the Kingdom of Saudi Arabia, didn’t immediately return a call yesterday seeking comment on the ruling.

Jerry S. Goldman, a lawyer for the plaintiffs, said in a statement that the decision is “soundly grounded and restores this case to the proper procedural posture.”

“This is a big step forward in the process of obtaining fair justice for the victims of this tragedy,” he said.

Goldman’s clients include family members of John O’Neill, a former federal counter-terrorism agent who had led investigations of Osama bin Laden and was working as the chief of security for New York’s World Trade Center when the attacks occurred.

Saudi Arabia is the world’s biggest source of funds for militant Islamic groups such as the Taliban in Afghanistan and Pakistan’s Lashkar-e-Taiba, and the Saudi government is reluctant to stem the flow of money, then-Secretary of State Hillary Clinton said in a 2009 cable obtained by Wikileaks.

Donors in Saudi Arabia constitute the most “significant source of funding to Sunni terrorist groups worldwide,” according to the cable.

Drew C. Bailey, a spokesman for the state department, declined to comment on the cable.

Cantor Fitzgerald Settles With American Airlines Over 9/11.


Cantor Fitzgerald LP settled a lawsuit accusing American Airlines of failing to stop the hijacking of a plane that crashed into the World Trade Center on Sept. 11, 2001, killing 658 of the firm’s employees.

U.S. District Judge Alvin K. Hellerstein in Manhattan was told of the agreement at a hearing today, according to court records. Hellerstein scheduled a Jan. 13 hearing to consider approving the accord.

The settlement of the lawsuit, filed almost 10 years ago, comes four days after American’s parent, Fort Worth, Texas-based AMR Corp., completed a merger with US Airways Group Inc. to form American Airlines Group Inc.

The al-Qaeda terrorists flew the American Airlines jet into one of the twin towers and a United Airlines jet into the other, causing both buildings to burn and collapse. Two other planes were hijacked, one that hit the Pentagon near Washington and another that crashed in a field in Pennsylvania after passengers fought the terrorists. About 3,000 people died.

Cantor alleged American should have stopped five Islamic extremists who took over its Flight 11 from Logan International Airport in Boston and crashed it into the North Tower.

 

In its lawsuit filed in September 2004, the New York-based based global financial services firm sought $945 million. A 2011 ruling in the airline’s favor limited Cantor to seeking damages for business interruption and barred it from seeking damages for the deaths of its employees.

In a related negligence lawsuit, Hellerstein ruled in July that real estate developer Larry Silverstein, who leased the skyscrapers about two months before they were destroyed, can’t seek $3.5 billion from AMR or United Continental Holdings Inc. Silverstein had already collected $4.1 billion from insurers and can’t collect twice under New York law, the judge ruled.

Robert Hubbell, a spokesman for Cantor, declined to comment on the settlement because the matter is still active in court.

Cheney: ‘Death Was Imminent, Not Frightening’.


Shortly after he left office in 2008, Vice President Dick Cheney knew his heart was failing and death was imminent. He believed he had just days to live.

“I was at peace. I had been anticipating for a long time, sooner or later, technology would run out,” Cheney told MSNBC‘s “Morning Joe” Monday. “Death was imminent. But it was not frightening.”

“I expressed my wishes to the family,” Cheney said. “In that 17-month period after I left the White House, it was steady downhill progression and culminated in July 2010. My heart was no longer moving enough blood to service my kidneys, my liver, and other vital organs. I had, at best, days left to live.”

A left ventricular device saved the former vice president, who had suffered from heart disease for 35 years. Cheney underwent a nine-hour procedure, and, later, a heart
transplant that saved his life.

Cheney stressed that people “can live with chronic heart disease,” and that he did not spend his time through the years fretting over health concerns.

“I didn’t go through life wringing my hands saying, ‘Gee, when am I going to have the next heart attack?’ I had incidents. I dealt with them. You can live with chronic heart disease,” Cheney said.

“Every time I went through one of these incidents, I dealt with it, and then I went back to work,” he added.

In a new book, “Heart: An American Medical Odyssey,” Cheney chronicles his years of heart problems and the innovations that have enabled people to live with heart disease.

With his health problems well known, the former secretary of defense and vice president often faced questions about his ability to perform under pressure. He recounted the events of Sept. 11, 2001, when those physical abilities were put to the test, as the U.S. was under siege.

“We were at war. And I was having to make decisions and work with the president and everybody,” he said. “I was in the bunker on 9/11 when they blew up the World Trade Center and the Pentagon — would have hit the White House or Capitol building, if it hadn’t been for the people on Flight 93.”

Practice exercises he had undergone trained him for handling emergency situations, Cheney said.

“That training sort of kicked in that morning. And, one of the main things we had to do is make sure the line of succession was protected,” Cheney said.

Angry Atheists Continue Relentless Attack on the Ground Zero Cross.

Following a big victory for the Ground Zero Crossearlier this year, where a federal judge threw out anatheist lawsuit to tear down the Cross, angry atheists are now appealing that ruling to a federal appeals court.

The Ground Zero Cross, two intersecting steel beams found in the wreckage of the World Trade Center, became a symbol of hope and healing for first responders on the ground in the wake of the 9/11 terrorist attacks and for thousands of Americans across the nation.

Angry atheists, from the particularly vitriolic American Atheists, demanded that it be torn down. They attempted to make a federal case of their hurt feelings and lost.

The trial court correctly noted that the Cross was a historic artifact–an actual piece of 9/11 history. It really meant something to those affected.

The angry atheists’ reaction was unsurprising. “We are angry that we have to have this fight,” said the president of the group, David Silverman.

Despite their unmitigated rage, placing this cross in a museum does not violate the Constitution. As theSupreme Court has repeatedly held that the Constitution’s “goal of avoiding governmental endorsement does not require eradication of all religious symbols in the public realm.” Simply put, the Constitution is not an atheist manifesto.

The fact is their lawsuit alleges that the mere “existence of the cross” has given them “depression,” “anxiety,” “mental pain and anguish,” and even “headaches.” For those who claim to have no faith, they are assigning near supernatural qualities to the cross.

Ironic as it is, their challenge to the cross, its historic significance, and the real impact it had on thousands of Americans is real.

Why Christian TV Is Growing Irrelevant.

The morning of 9/11, I had a brainstorm. Watching the horror unfolding at the World Trade Center, I immediately sent a fax (remember faxes?) to every owner or manager of every Christian television station I knew. I begged them to interrupt their regularly scheduled programming and start reporting on the tragedy in New York.

Obviously, they didn’t have the budget or manpower to compete with major news networks, but they could report on the spiritual perspective of what was happening, offer comfort or help people understand the religious issues behind it. Many took my advice and brought in experts on Islam, Bible scholars, college professors and local pastors, and one station even did a cellphone interview with a person who was actually being evacuated from one of the towers. The response was incredible, and I was hoping it would shake Christian TV stations out of the scheduled programming rut so that we could build media platforms that dealt with immediate issues Americans are facing.

But since then, for the most part, Christian TV has returned to its “regularly scheduled programming.” Just these past few days and weeks, we’ve seen major events unfolding internationally in Syria,Pakistan and Kenya. Most of these events have direct religious implications, and most directly involve Christians. And yet when it comes to Christian TV—the Christian medium with arguably the largest audience—where is the reporting, interviews, commentary, insight or biblical perspective?

It’s tough to find.

Christian television continues to grow more and more irrelevant because we refuse to take the time or trouble to address issues that really matter—when they matter. If you work at a Christian station or network, think about it. I’m all for sermons, Bible teaching, interview shows and movies. But consider the power of live, immediate programming with experts who can help us understand these world events. Look around at the Christian universities in your area, at the pastors and ministry leaders who may be experts on the issue, or find other sources of information.

We get upset because secular journalists don’t get the spiritual perspective of what’s going on, and yet when it comes to TV, are we offering a better alternative?

DUBAI, United Arab EmiratesAl-Qaida leader Ayman al-Zawahiri urged small-scale attacks inside the United States to “bleed America economically,” adding he hoped eventually to see a more significant strike, according to the SITE monitoring service.
In an audio speech released online a day after the 12th anniversary of the 9/11 strikes, Zawahiri said attacks “by one brother or a few of the brothers” would weaken the U.S.economy by triggering big spending on security, SITE reported.
Western counter-terrorism chiefs have warned that radicalized “lone wolves” who might have had no direct contact with al-Qaida posed as great a risk as those who carried out complex plots like the 9/11 attacks.
“We should bleed America economically by provoking it to continue in its massive expenditure on its security, for the weak point of America is its economy, which has already begun to stagger due to the military and security expenditure,” Zawahiri said.
Keeping America in such a state of tension and anticipation only required a few disparate attacks “here and there,” he said
“As we defeated it in the gang warfare in Somalia, Yemen, Iraq and Afghanistan, so we should follow it with . . .war on its own land. These disparate strikes can be done by one brother or a few of the brothers,” Zawahiri said.At the same time, Muslims should seize any opportunity to land “a large strike” on the United States, even if this took years of patience.\

The Sept. 11 attacks — in which hijacked airliners were flown into New York’s World Trade Center, the Pentagon in Washington, and a Pennsylvania field — triggered a global fight against al-Qaida extremists and their affiliates. Almost 3,000 people were killed in the attacks.
In his audio speech, Zawahiri said Muslims should refuse to buy goods from America and its allies, as such spending only helped to fund U.S. military action in Muslim lands.
